Terms of Service

1. Acceptance of Terms

By accessing or using ZenVPS services ("Services"), you agree to be bound by these Terms of Service ("Terms") and our Acceptable Use Policy. If you do not agree, you must not use our Services.

2. Services Provided

ZenVPS provides Virtual Private Server (VPS) hosting, including compute, storage, and network resources. Services are provided on a subscription basis as described on our website.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must be at least 18 years of age.

4. Payment Terms

• All prices are displayed in the currency shown at checkout and are exclusive of applicable taxes unless otherwise stated.
• Services are billed in advance. Invoices are generated automatically and payment is due upon receipt.
• If payment is not received within 3 days of the due date, your VPS will be automatically suspended.
• If payment remains outstanding for 7 days, your VPS and all associated data will be permanently terminated.
• No refunds are provided for partial billing periods or unused resources.

5. Acceptable Use Policy (AUP)

You agree not to use ZenVPS services for any of the following:

• Spam: Sending unsolicited bulk email, phishing messages, or any form of email abuse.
• Cryptocurrency Mining: Mining of any cryptocurrency (including but not limited to Bitcoin, Ethereum, Monero) is strictly prohibited on all plans.
• DDoS Attacks: Launching, facilitating, or participating in Distributed Denial of Service attacks from or through our infrastructure.
• Network Abuse: Port scanning, IP spoofing, DNS/NTP/SSDP amplification, or any activity that degrades network performance for other customers.
• Illegal Content: Hosting, distributing, or linking to child exploitation material, terrorist content, or any material illegal under EU or international law.
• Malware Distribution: Hosting command-and-control servers, botnets, ransomware payloads, or exploit kits.
• Trademark/Copyright Infringement: Hosting content that violates the intellectual property rights of third parties.
• Resource Abuse: Deliberately overloading shared resources (CPU, RAM, I/O, bandwidth) in a manner that impacts other customers.
• Torrenting: Using BitTorrent or similar P2P protocols to distribute copyrighted material.

Violations of this AUP will result in immediate suspension or termination of your account without refund. ZenVPS reserves the right to report illegal activities to the appropriate law enforcement authorities.

6. Service Availability

ZenVPS targets 99.9% uptime but does not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible. ZenVPS is not liable for downtime caused by factors beyond our control.

7. Data Responsibility

You are solely responsible for maintaining backups of your data. ZenVPS does not guarantee data preservation in the event of hardware failure, account termination, or service disruption. You are encouraged to maintain independent off-site backups.

8. Limitation of Liability

To the maximum extent permitted by law, ZenVPS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, regardless of the cause of action.

9. Termination

ZenVPS reserves the right to suspend or terminate your account at any time for violation of these Terms or the AUP. You may cancel your account at any time through the client panel. No refunds will be issued for the remaining billing period.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union and the applicable member state where ZenVPS operates.

11. Changes to Terms

ZenVPS reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of the Services constitutes acceptance of the modified Terms.
